The Special Court of Appeal has upheld the First Instance decision on the confiscation of the apartment of the former head of the Constitutional Court, Bashkim Dedja.

The latter is accused of hiding it in the decriminalization form.

The apartment is in the name of the brother of the former Constitutional Court judge. SPAK's request for confiscation of the property is based on the anti-mafia law.

Former Constitutional Court President Bashkim Dedja is facing charges of false declaration or concealment of assets, after he failed to justify an apartment he owns with legal sources.

The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Saida Dollani (presiding), Nertina Kosova (member) and Miliana Muça (member), today, on 27.01.2026, announced the decision regarding the case registered on the appeal filed by the appellants Bashkim Dedja and LD, against decision no. 5, dated 24.04.2025, of the Special Court of First Instance for Corruption and Organized Crime, ruling as follows:

  1. Confiscation of the immovable property (apartment) registered with No. ****, volume ****, page ****, with an area of ​​60 m2, located in the cadastral area ****, Administrative Unit ****, Municipality ****, registered in the name of citizen LD, seized by decision no. 08, dated 20.04.2021 of the Special Court of First Instance for Corruption and Organized Crime, and its transfer in favor of the state, ordering the immediate execution of this decision.
  2. The court secretary is ordered to send a copy thereof to the Sequestered and Confiscated Assets Administration Agency, for immediate execution of the decision. Court costs as incurred.
  3. An appeal against this decision is allowed within 15 (fifteen) days from the day after the notification of the reasoned decision, to the Special Court of Appeal for Corruption and Organized Crime.”
  4. In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided: – Upholding decision no. 5, dated 24.04.2025 of the Special Court of First Instance for Corruption and Organized Crime. – The procedural costs of the appeal trial are jointly and severally borne by the appellants. It was announced on 27.01.2026.
