The company "ONE" has announced a 2.2% increase in service prices for several days, but according to lawyer Ervin Ymeraj, who has denounced this move from the beginning, it may be abusive and incomplete in terms of information to subscribers.
"The ONE company in the contract recognizes the right to increase the price unilaterally and automatically, but the client has some rights that the contract cannot affect. The clauses of the contract must be clear and understandable. The client must be well-informed from the beginning and know that any price change will directly affect him. This is not clarified in the notification sent by SMS. Subscribers should receive information in private, but it is not explained in the ONE notification whether they have the opportunity to object," he said.
According to the lawyer, the way the company communicated the price change does not respect the right to clear and direct information for subscribers.
"This makes the price increase abusive and the change in contractual terms was made without mutual consent. The information provided by the company is unclear and voluminous. Any subscriber can object and the company must take this into account. If the consumer does not intervene and does not object, this is considered acceptance, and the increase can continue," the lawyer says.
The lawyer adds that the notification forms from ONE are not appropriate and do not respect the right to transparency and the opportunity to object. He considers that if the price increase clause was in the contract, it is unfair and creates consequences for subscribers.
"This is a cost for every citizen. The state must intervene, starting with AKEP, the Commissioner for Consumer Protection, but also civil society, so that the consumer is as protected as possible," he said.
Lawyer Ymeraj emphasizes that subscribers have the right to object to the changes.
"From May 1, subscribers have the right to request non-acceptance of the changes and can request termination of the contract," he emphasizes.
The price increase by “ONE” is not just a technical change to the contract; it is a violation of consumer rights. At the microphone of News24, citizens opposed this increase, but according to the lawyer, subscribers have the right to react legally, while state institutions and civil society must intervene to guarantee that every citizen does not pay the consequences of a unilateral and unclear increase.
