Lawyer Erald Aga, invited to the studio of the show "Time to Wake Up" in News24, spoke today about the importance and function of prenuptial agreements in Albania. According to him, these contracts allow couples to clearly define their property and family arrangements before getting married.
"The prenuptial agreement makes it possible for a man and a woman, before marriage, to enter into an agreement and file it with the civil registry. This is done at the notary, where they can go in person or through a proxy, such as a lawyer. At the time of the celebration, the contract is officially filed," explained Aga.
He emphasized that the property that each partner has before marriage is not divided, as it remains the personal property of each. The prenuptial agreement, according to him, relates only to the property that is created after the celebration. “Different divisions of property or even issues related to the custody of children in the event of divorce can be determined. The parties take responsibility for what will happen next,” the lawyer added.
Aga acknowledged that there is still a prejudice against prenuptial agreements in society, as they are often perceived as a lack of trust or as an indication that the marriage is for material interests. “In fact, not everything is divided in marriage. Only the property that starts from the moment of celebration is divided,” he concluded, emphasizing that the prenuptial agreement is a legal way to avoid potential conflicts in the future.
