Former Minister of Justice, Eduart Halimi, in an interview on the show "Oponencë" on News24, has called the government's attempt to amend Article 242 of the Constitution regarding the suspension of ministers an illusion.

Halimi said that despite Rama's attempts to make SPAK's work more difficult, he will not succeed because the hierarchical norm that is the Constitution is a priority.

Eduard Halimi:  In my view it is an illusion., No matter how hard he tries to create a protective shield, no matter how hard he tries to change the criminal procedure code, he cannot do it because the hierarchical norm that is the Constitution takes priority.

It will not succeed in making SPAK's work more difficult, despite the fact that it is seeking to provide peace of mind to ministers who will not be suspended if the proposed amendment to Article 242 of the Criminal Code is approved, this is an illusion. SPAK will implement the Constitution. The last time the Assembly spoke about parliamentary immunity was in 2012. I was Minister of Justice and I led the process. We approved the removal of immunity for MPs and judges, and since then, Article 73 of the Constitution, which provides for immunity protection that does not include suspension, has not been changed.

Any change you make to the Code of Procedure, the GJKKO will directly apply the Constitution and will maximally take the case for incidental review to the GJK. And this is the government's approach and those same judges are waiting for it there. 4 of them tell it that if you want to protect the government from suspension, you have to change the Constitution. 4 judges tell the government in the decision that was overturned, that if you want to protect it from suspension, the Constitution should be changed, not the article. The government's goal is to drag out the case. In the constitutional context at this moment, the GJKKO will apply the Constitution, despite the government's illusory efforts.
