Full press release from the Elbasan Court:
"On the detention of the lawyer after the process conducted in court". The First Instance Court of General Jurisdiction of Elbasan expresses regret for the concern created in public opinion and in the legal community, regarding the detention of lawyer Ulian Barjami, carried out on 18.10.2025.
The Court values the irreplaceable role of the lawyer in the judicial process and is committed to maintaining cooperative relationships and mutual respect between all justice actors.
The court clarifies that the lawyer's detention was not carried out on its premises and is not related to any judicial decision. The prosecution has assessed this detention as illegal and no request for review of this event has been submitted to the court.
On 17.10.2025, a hearing was held to assess the legality of the arrest in flagrante delicto and the imposition of security measures for 14 persons, including a minor. Attorney Ulian Barjami was present as the defense counsel for the detainee MS. The hearing was held behind closed doors and lasted over six hours; the audio-video minutes were made available to the proceeding body upon their written request. Given that the hearing was held behind closed doors, the court underlines the importance of careful and correct information in order to preserve the privacy of minors and the rights of the parties. We emphasize that the partial publication of a long recording does not necessarily reflect the entirety of the procedural debate between the parties.
The Court condemns in principle any form of interference, pressure or intimidation against justice actors — judges, prosecutors, lawyers and any other procedural subject — and reiterates that lawyers are partners in justice and indispensable defenders of citizens' rights. In accordance with the standards of the European Court of Human Rights (ECHR), including the case of Nikula v. Finland, the Court underlines that respect for the lawyer's freedom of expression in the exercise of his functions is an essential element of a fair trial.
These standards are a guide for Albanian courts in maintaining the balance between the authority of the court and the right of the defense. The court guarantees that any case submitted for consideration will continue to be treated impartially and in accordance with the law; encourages discreet and professional communication of all participants in the process; and invites the media to inform the public accurately about procedural developments, while respecting the legal restrictions on closed sessions and the protection of minors.
The Court will continue to cooperate closely with the National Chamber of Advocates and other justice institutions to strengthen mutual respect, professional integrity and citizens' trust in justice.
Thanking you for your attention,
