The hearings for the determination of security measures against 31-year-old Kostandin Vogli and 50-year-old Tori Ruci alias Viktor Ruci were held today at noon, one after the other.
It was precisely the ownership conflict between these two people, for a Beach Bar on the coast of the Himara Municipality, that later degenerated into a fight with hard objects and even the murder of 66-year-old Rexhep Ismaili, on the evening of May 7 in Gjashtë, Saranda.
The first to appear before the black squads was 50-year-old Tori Ruci. He was detained by the police on Saturday, after being placed under house arrest for the criminal offense of "Failure to report a crime."
During the session to verify the conditions and criteria for the implementation of the measure, Judge Mikel Hysometaj decided to continue the implementation of the security measure "House arrest", forcing the suspect not to leave his apartment in the village of Gjashtë, Saranda. Ruci has previously been convicted of "production and sale of narcotics".
Then, the prosecutor in the case, Armida Kaçi, and judge Mikel Hysometaj moved to the "Petro Nako" hospital in Saranda, where 31-year-old Kostandin Vogli, wounded by a gunshot to the leg, is being held under security measures.
The prosecutor had filed three charges against him, specifically "Failure to report a crime", "Destruction of property" committed in collaboration and "Threat" committed in collaboration. Judge Mikel Hysometaj accepted Prosecutor Kaçi's request for the security measure "Arrest in prison" against the 31-year-old.
Although the measure was imposed for the charges brought by the Prosecution, the Court shared an opposite position with the Prosecutor regarding the issue of the legal fact. For the Court, the appropriate legal qualification up to this moment, based on the acts presented, should have been “Intentional Murder” committed in collaboration, remaining in attempt, “Failure to report the crime” and “Destruction of property” committed in collaboration.
