A 42-year-old man has taken legal action against a restaurant after his wife exposed his extramarital affair through a video posted on TikTok, raising serious issues about privacy and the use of customer footage on social media. The man was reportedly filmed inside the restaurant without his knowledge or consent. The footage was then posted on TikTok, where it was viewed by his wife, leading to the discovery of the affair and serious consequences for his family life.
42-year-old is legally represented by Codacons, one of the most well-known Italian consumer protection associations, which claims that the restaurant acted illegally, violating fundamental privacy rights.
“It is unacceptable for a restaurant to film customers without their consent and then publish the footage, exposing them to unforeseen consequences,” said Francesco Tanazi, a spokesman for Codacons. According to him, such cases can have extremely serious consequences for the private, family and social lives of individuals, especially when the content is widely shared on social networks.
Codacons has announced that it is seeking financial compensation on behalf of its client, while also considering the possibility of filing a complaint with the Italian Data Protection Authority, to investigate whether privacy and data processing laws have been violated.
The case has sparked debate in Italy over the limits of businesses' use of social media and the legal responsibility they bear towards their customers.
