News24 reveals details from SPAK's investigations regarding the predetermination of the winning consortium for the construction of Vlora Airport.
In the Special Prosecution's file, it is stated that "there are suspicions that the members of the concession awarding commission, in collaboration with each other, have favored the merger of the companies "Mabco Costruksion", "Yda Group" and "2A Grup" in the qualification and in the announcement of the winner of the concession procedure."
The investigation into this matter began after the complaint of the company Al-De corporation LTD, through citizen Aldi Celi. 5 years after this complaint, SPAK says that: "From the investigative actions carried out, it resulted that the members of the concession award commission did not ascertain the lack of necessary documentation for the merger of the winning economic operators, Mabco Construksion sh.a, YDA Groop and 2A group, but they qualified and subsequently declared it the winner in violation of the rules of the competitive procedure", SPAK emphasizes.
The investigations show that after the creation of the association of economic operators, the members of the group must determine with prosecutors their representative for the submission of the bid.
The written agreement and the power of attorney must be submitted together with the qualifications and economic offer and signed by the representative, but this requirement has not been met by the 2A group company.
Investigations have further revealed that the economic operators have not submitted balance sheets and audit reports for the required years, the company 2 A Group for 2016 and the company Mabatex for 2019.
Also, the companies "Mabco Construction" and "Yda Group" have not submitted documentation for the ultimate beneficiary of the shares, which would determine the percentages of each shareholder up to the ultimate owner.
Regarding the technical capacity criterion, one of the companies had to prove that it had resurfaced 10 runways in the last 10 years, built at least 2 terminals in the last 15 years, and built 1 air traffic control tower in the last 15 years.
Investigations show that this request has not been fulfilled by the companies Mabco and Yda Group. The company Mabco Construction submitted documentation for the Nursultan Nazarbayev Airport, Astan Kazakhstan, but SPAK says that there is no evidence of the implementation of the construction of an air traffic tower, but only confirmation remains through a letter from the Deputy Prime Minister of Kazakhstan.
The prosecution has communicated the charge of violating equality in tenders, committed in collaboration with 7 members of the concession award committee, as there are suspicions that they favored the merger of the companies Mabco Construction, Yda Group and 2A Group in the qualification and announcement of the winner of the concession procedure.
