In the show "Në Shënjestër", with author Klodiana Lala in News24, data was published from the "Elbasan-Qafë Thanë" road expansion project, which began in 2020.
"Në Shënjestër" has revealed the absurdity of this project, which has to do with the disqualification from the competition of companies that had a serious CV to carry out a project with highway standards that is part of Corridor 8.
Even though these companies also submitted a list of the best engineers in the field for road design studies in the country, they were still not taken into consideration by either the ARA or the Public Procurement Commission.
Thus, on October 27, 2020, Jonaid Myzyri and four of his subordinates decided to dismiss the complaint filed by the union of four operators, who sought to design the expansion of the Elbasan-Qafë Thanë road.
The fact that four companies submitted a complaint for this tender and offered all their experience in designing a road with contemporary standards shows the level of seriousness of these companies.
Their complaint was even legitimized by the Public Procurement Commission, but again the latter chose a subjective assessment by disqualifying from the competition companies that could have conducted a more serious study for a road that passes through difficult terrain.
After the completion of the appeal procedure, the Albanian Road Authority, on December 31, 2020, concluded a contract with the companies 'InfrasKonsult' shpk and 'HMK Consulting' with a financial value of 610 thousand euros, while within 9 months these companies would have to carry out the study-design of the expansion of the Elbasan-Qafën Thanë road.
The study and design time for a road with a total length of 54 km is insufficient, taking as a reference the fact that for studies of this level, the ARA itself has set a minimum time period of 20 to 24 months.
After the tender announcement by the ARA, on July 29, 2020, with a fund limit of 530 thousand euros, the time for submission of documentation by interested companies would be only two weeks.
So, by August 12 of that year, they had to submit financial bids for the study and design of this road.
8 companies or operator associations participated in the competition, while the winner was the operator association 'InfrasKonsult' Shpk and 'HMK Consulting'.
But the tender for the design of the expansion of Corridor 8, Elbasan-Qafë Thanë segment, was appealed to the Public Procurement Commission, an institution that was at the time headed by Jonaid Myzyri.
The complaint was filed by the joint venture of operators '47EK79 & Iliriada' PKS shpk & 'SRP Albanian Engineering' shpk & 'CEC' Group shpk has filed a complaint with the contracting authority, with the following claims:
"We were evaluated by KVO with the following points: Total average points 87.967 points divided into; Experience in similar work (average) 9.000 points; Proposed methodology (average) 22.800 points.
Qualifications of the proposed key staff (average) 56.167 points.
Based on the experience in similar work, the proposed methodology and the qualifications of the key staff proposed by us, we oppose the assessment made by the KVO as '47EK79 & Iliriada PKS' shpk & 'SRP Albanian Engineering' shpk & 'CEC' Group shpk should have been assessed with maximum points for: Experience in similar work (the assessment should not be subjective, but objective, based on the Standard Tender Documents and the Public Procurement Law), states the complaint filed by the union of operators '47EK79 & Iliriada' PKS shpk & 'SRP Albanian Engineering' shpk & 'CEC' Group shpk.
In fact, starting from what happened at the beginning of this year with the road landslide in Librazhd, in the complaint document filed by the companies for the design tender, there is data showing that these companies had previous experience with segments where there had been road landslides.
One of them was the design of landslide stabilization in the Tirana-Krrabë segment, on the Tirana-Elbasan highway or the stabilization of landslides in the Romanat-Plepa Durrës segment.
On page 13 of the decision, the study of this landslide is given as part of the CV of the companies, which through this data proved that they also had the experience to design roads that were at risk of landslides.
But despite the fact that the economic operators submitted a CV with dozens of similar projects for road study and design, their complaint was not taken into account.
The absurdity lies precisely in the assessment of the Public Procurement Commission.
Where on page 19 of the decision, it is written that:
"In this context, the Commission considers that the KVO's assessment of this important component of the technical proposal of 9 points is sufficient, while the argument of the complaining economic operator for a maximum assessment from the review of the entire documentation does not result to be well-founded."
The Commission considers that the assessment carried out by the KVO was carried out in accordance with the documentation submitted by the complainant, a reasonable assessment which the Commission considers to remain unchanged. The scoring process in consultancy procedures must be carried out in accordance with and in proportion to the documentation submitted by each tenderer, which in turn must be as close as possible to the requirements and criteria set out by the contracting authority in the tender documents.
The spirit of the LPP is such that each operator must prepare its bid in accordance with the criteria and requirements provided in the tender documents.
"The above claims of the complaining BOE do not hold up," the Commission's response states.
