The Constitutional Court will decide today on the government's request regarding the "Balluku" case.
The government has filed a complaint with the court, requesting the cancellation of the security measures imposed by the GJKKO for Deputy Prime Minister Belinda Balluku, claiming that she has violated the Constitution and has taken over the powers of the Prime Minister, the President, and the Assembly.
The Constitutional Court is expected to decide today what will happen with the request after the decision has been postponed several times.
The Prime Minister's appeal was filed on November 21. The file was forwarded to the College of Judges, which convened, but the meeting was postponed to December 2. However, the College did not have unanimity and the file was forwarded to the Meeting of Judges, which will decide today on the fate of the file.
In the request sent to the Constitutional Court, the Council of Ministers states that the decision of the Special Court to suspend the Deputy Prime Minister and the Minister of Infrastructure and Energy directly interferes with the competencies of 3 state bodies: the Prime Minister, the President, and the Assembly.
"The suspension brings serious consequences for the state and social interest by creating an institutional vacuum as it prevents the proposal of projects of national importance for integration into the European Union, around 800 projects to be approved by the end of 2027 by the ministry led by the minister, who has been suspended through the decision of the GJKKO," the Council of Ministers reasons.
According to the government, Belinda Balluku could not be suspended from office, as in her capacity as a member of the government she enjoys the rights of an MP.
We recall that the GJKKO imposed 2 security measures on Belinda Balluku, suspension from duty and a ban on leaving the country. Also, the GJKKO imposed house arrest on Gentian Gjylin, director of ARRSH, and Erald Elezin, administrator of KESH. They are accused of committing the criminal offense, “Violation of equality of participants in tenders or public auctions”, committed in collaboration, provided for by articles 258/2 and 25 of the Criminal Code, in relation to the criminal fact relating to the procurement procedure with the object “Construction of the Llogara tunnel”.
Both Balluku and her subordinates are accused of the tender procedures for the Llogara tunnel and the Tirana Ring Road. The Llogara tunnel tender had a value of 190 million euros, 50 million euros more than the first procedure where “Gjoka Konstruksion” was declared the winner but which was later canceled and the second time was given to the Turks. Meanwhile, the Tirana Ring Road, its lot 4, was built by the merger of the companies Euroteorema, Pe-vla-ku and NOVA Construction, with a fund of 20 million euros.
