Former Gjirokastra Chief Judge Guximtar Boçi has requested reinstatement to his previous position two years after his suspension from this position. His request comes after he was declared innocent by a decision of the Vlora Court of Appeal in September 2018.

In the request made on 20.12.2018 for the revocation of the measure of suspension of the exercise of the judge's duties issued by decision no. 102. Date 28.10.2016 of the High Court of Justice, provided by "BalkanWeb" It is noted that the dismissal was carried out on 28.10.2016 after an extraordinary meeting at the request of the Minister of Justice of the time.

"According to the minutes of this meeting, it turned out that a good part of the members of the HCJ requested the postponement of the meeting to verify the case and to give the accused the right to be heard, but, always according to these minutes, the dismissal decision was given after the insistence of the Minister of Justice and the President of the HCJ that not taking concrete measures would condemn them in the eyes of public opinion," the request states.

Judge Boçi's dismissal was based on several facts made public in the media, in an investigative show, where he was accused of sexual affairs and passive corruption.

The request of the Gjirokastra judge for reinstatement comes at a time when the investigations have not concluded in favor of the RI citizen's request, thus dismissing the reason for the suspension of the former Gjirokastra chief judge, while the criminal case has been dismissed and appeals against this decision have been suspended by a final court decision.

On the other hand, the law provides for a time limit of three months to two years for the suspension measure, a period which has expired, giving Judge Boçi the right to request reinstatement. The suspension decision that was taken on 28.102016 ended its two-year term on 28.10.2018.

Former judge Boçi has repeatedly filed requests to the High Court of Justice since 09.06.2017 and onwards, requesting reinstatement, but his requests have not been considered. The first request was filed on 9 June 2017, while the last request addressed to the new body, the High Court of Justice, is dated 20 December 2018 and is expected to be reviewed within the legal deadlines.
