Journalist Klodiana Lala spoke this evening on journalist Sokol Balla's "Real Story" show, in News24, for the debate between institutions on the election of members of the Constitutional Court.
Lala said that the Constitution does not set a deadline for the President to select his members for the Constitutional Court, but she added that the fact that the country has been without this court for a long time made the selection of members more urgent.
"When the lists went to the President and the Assembly, the law states that it is the President's turn first, then the Parliament and finally the Supreme Court, which has not yet been established. In a letter-by-letter reading of the law, the President is not given a deadline. Referring to several previous decisions of the Court, the President cannot postpone the matter indefinitely. In the conditions when the country is without a Constitutional Court, this made the selection of members more urgent, as there are a number of issues that this court must review. In an attempt to capture the Constitutional Court and to have as many members as possible, they started the game," said Lala.
The journalist further criticized the President for selecting the first member of the Constitutional Court, prosecutor Besnik Muçi, as he has not yet passed the Vetting Law.
"The President's choice of Besnik Muçi was wrong, as he did not pass the Vetting. There is no final decision for him. But, to overcome this, it was the Assembly's turn. They have entered into a game of squash, but the most problematic is the KED. They submitted two lists, which were essentially four names on one and three on the other, which gave them the opportunity to choose a member of both institutions," the journalist said.
