The Court unmasks the Prosecution, it did not conduct investigations into the Boçi family
In 2017, the Lushnja Prosecution Office, with the prosecutor in charge of the case, Skënder Mestani, would launch investigations into the Boçi family case. Bukuria and Dhimo would file a report for abuse of office, but also for falsifying documents, and these two reports would be merged under a single investigation. Only in this case we would have a clash between the Prosecution Office and the Lushnja Court, where the latter would ask the Prosecution Office in both cases to conduct in-depth investigations. Former prosecutor Mestani would request the dismissal of the case, but the Lushnja Court would request the reopening of the investigations since they had not been fully completed, while paradoxically the Prosecution claimed that we could be within the statute of limitations.
On the other hand, the Prosecution Office had not conducted full verifications and investigations to secure these conclusions. The Vlora Appeals Prosecution Office would do the same, which would request the dismissal of the case, but the case would be returned to Lushnje to conduct full investigations since there were actions that had not been verified.
"We requested the criminal report, Vasillaq Ziu took the criminal report from us, but we didn't know, let's go ahead and file a criminal report. What did Vasillaq Ziu do?
He didn't get a criminal report, but he got a statement. When did we learn this?! We learned this because we said why isn't the Prosecution calling us for this sensational event that we were raped. We went there, the prosecutor was Artan Azbiu. We told him we have a property, we went to Bubullima... will there be a trial for this matter? He told us, you don't have a criminal report. So what do we have? You have a statement and there is no report for you", Bukuria expresses in disappointment.
Bukuria claims that the case has dragged on and it has not been established anywhere that she and her husband were raped, accusing them of interference by the State Police to their detriment. An interesting element emerges from the Prosecution's file, where all the people questioned, starting from the bailiffs and people close to the former ALUIZNI and the former Property Registration Office, claim that they did not know that the property was registered in the name of the Boçi family.
"There, my husband's prosthesis broke and he had chest injuries and we didn't take these things into account because Vasillaq Ziu called him the day before, saying we said "we're not going today because we're not able to go because we were raped", but we went to the forensic doctor the next day and after that we went and talked to the prosecutor. He did an X-ray and the X-ray showed that there was a collapse in the chest. He didn't tell us, it was the forensic doctor's duty to take my husband for a check-up", said Bukuria, highlighting that their rape has been buried by the institutions.
From the investigations of former prosecutor Skënder Mestani, it results that specialists and officials at the National Inspectorate of Territorial Protection were questioned about the reasons why the Enforcement and Inspectorate of Territorial Protection in the Municipality of Lushnje were not supported with machinery.
But the failure on the ground was no coincidence. The documents reveal that behind every defect in the fadroma was a chain of contradictory evidence, while the former head of IMT Lushnje, Shaqir Zhama, claims that his requests were ignored, other leaders of the Lushnje Municipality have forgotten the event, leaving responsibility without an author.
On the other hand, the IKMT responded by stating that the responsibility was with the Lushnje Municipality and that their vehicles were busy with actions in cities like Himara or on national roads. At one point, bailiff Luiza Gjergjova attempted to intervene with the fadroma found by the owner Dhimo Boçi himself, but the action failed due to conflicts on the ground with Genci Gjoka's family members, which forced the intervention of the Police. After this incident, no vehicle refused to go to that property for fear of clashes with the owners of the building.
