Former prosecutor Besnik Muçi, while commenting on the 'Balluku' case, for which SPAK is seeking his arrest, claimed that the Constitutional Court should have expressed its decision. In the lunch program at News24Muçi said that the Court feels under pressure, although according to him the issue is very simple.
He said that the Venice Commission should have expressed its opinion before the plenary session on the Balluku case.
"Today the Constitutional Court has not spoken for 1 month. It has not spoken! Overturn the request, accept Rama's request and overthrow SPAK. Why are you doing this? Justice reform has failed! The Constitutional Court does not have the courage to speak, even though it is a simple issue, it does not have the courage to speak. It must be investigated why the court is not speaking! There is no need for time on this issue. The issue is simple. There is something wrong. If the request were legally clean, the answer would have been given the next day. But the fact that it is not speaking, it seems that there is pressure. Now it is reluctant to give it, since the law and the constitution are on the side of SPAK. At these moments, investigations are being damaged, evidence is being destroyed. For me, it is a simple issue. The Constitutional Court can turn to Venice and before the plenary session is held. It should have done this too. But in the situation we find ourselves in, it is the agony of our institutions. It is not new! Justice reform did this. A lot was spent "Before, but the system was destroyed. Justice reforms have failed! We were all waiting to see why the EU wasn't saying it, but they also spoke out," he said.
