Another institutional clash has been registered between the mayor of Tirana, Erion Veliaj, and the High Prosecutorial Council, regarding the status of prosecutor Ols Dado.
In an official request addressed to the members of the KLP, Veliaj claims that his request for the determination of the absolute invalidity of the decree appointing Ols Dado was not reviewed by the collegial constitutional body, but only by the vice president of the institution, Erind Gërmenji.
The document states that during the trial at the Tirana Administrative Court of First Instance, it was determined that there is no collegial decision-making by the KLP on this issue.
According to the request, letter no. 413/3 prot., dated 11.03.2025, signed by Erind Gërmenji, which states that "KLP reviewed the request", does not correspond to the procedural reality.
Veliaj claims that in practice the request was handled personally by the vice president of the KLP and not by the institution itself as a collegial body, as provided for by law.
"It turns out that the content of the letter does not correspond to the procedural reality of the handling of this request," the document states.
The request argues that Article 66 of the Law "On the Status of Judges and Prosecutors" recognizes only the High Prosecutorial Council as having the authority to decide on the termination of the status of a magistrate.
For this reason, Veliaj claims that the document signed by Gërmenji is a "null act", as it lacks a collegial decision of the KLP.
The Mayor of Tirana also raises questions about the representation of the KLP in the trial by the institution's legal representative, claiming that she appeared without a mandate approved by the collegial body.
At the end of the request, Veliaj asks the members of the KLP to inform whether they were aware that Deputy Chairman Erind Gërmenji "has personally considered and decided regarding the termination of the status of Ols Dado magistrate."
