The Elbasan Court of First Instance of General Jurisdiction rejects the request of the former mayor of Kukës, Safet Gjici, to replace the remaining part of the sentence with home confinement due to health conditions.

The defense claimed that Gjici has so far served over 2 years in prison, out of a total of 3 years, with the remainder of the sentence being required to be served in his own home.

The reason remains health-related, where the former mayor, due to his serious psychological condition, has worsened and is currently diagnosed with aortic enlargement, cardiovascular problems and diabetes, a disease for which the convict has received treatment before, referring to medical records.

The former mayor of Kukës has been definitively sentenced by the Appeals Court of Kosovo to 3 years in prison for "passive corruption", following the sexual scandal in his office, published in June 2023.

Accusations against the former mayor of Kukes

Safet Gjici was arrested on June 24, 2023, following a video scandal recorded in his office where he had intimate relations with a woman (Akma K).

Initially, on February 7, 2024, the Special Court of First Instance for Corruption and Organized Crime sentenced Gjici to two years in prison.

But on June 24, 2024, the Special Court of Appeals overturned the first-instance decision for Safet Gjici, and sentenced him to 4 years and 6 months in prison, but thanks to the summary trial, 1/3 of the sentence was reduced, ultimately being sentenced to 3 years in prison.

While Alma Kaçi was sentenced to 1 year in prison.

Safet Gjici was also stripped of his right to hold public office for 5 years.

DECISION

The Court of First Instance of General Jurisdiction of Elbasan, in the framework of transparency, with the aim of informing the public in the assessment of the high public interest, informs about the court session of the Criminal Request in the Execution Phase presented by the applicant Safet Gjici with the subject of "Replacement of the Sentence with Staying at Home". The applicant Safet Gjici did not appear at the session, the defense represented by av. Markeljan Jança appeared, the prosecution with prosecutor Mr. Ledian Tema appeared, and the Forensic Experts appeared. The Evidence Service has presented the expert report. The legal representative of the Lushnje Criminal Decision Institution appeared.

Today, 30.01.2025, the First Instance Court of General Jurisdiction of Elbasan with a panel composed of: Presiding Judge Ms. Suela Lika at the end of the trial, after hearing the parties in the final discussion with decision No. 295 Decision of 30.01.2025 in application of articles 112, 379, 470 of the Code of Criminal Procedure and article 59/a of the Criminal Code decided:

1. The rejection of the request of the applicant Safet Gjici,
2. The court costs are charged to the applicant Safet Gjici,
3. An appeal against this decision is allowed at the Court of Appeal of General Jurisdiction of Tirana within 15 (fifteen) days, starting from the day after the notification of the decision.
