A land ownership conflict on Gostencka Mountain in Skrapar has been the subject of a denunciation on the show "Tak Fak" in News24Miranda Jaupaj claims that the company "Topi EKI" sh.pk, with administrator Anesti Topi, is exploiting her family's property in violation of court decisions and without legal documentation, accusations that the company denies.

Miranda Jaupaj says that the property in question was purchased by her grandfather, Tefik Bektash Jaupi, in 1933. According to her, after the fall of the communist regime, the family began collecting documentation for the lands taken during that period, while in 2009 the court made a final decision, recognizing her grandfather's ownership rights.

Jaupaj accuses the company “Topi EKI” sh.pk of exploiting this territory, which, according to her, has the legal status of forest-pasture and is not a mining area, since 2014. She claims that, despite security measures and court decisions, the activity continues, while the responsible institutions have not intervened to stop what the family considers to be illegal exploitation of the property.

In her complaint, Miranda Jaupaj also raises charges of forgery of documents and misappropriation of other properties. She says the family has faced threats and pressure from administrator Anesti Topi, who, according to her claims, has told them that he is above ministers.

During field reporting, "Tak Fak" journalists, together with the heirs of the Jaupaj family, met with administrator Anesti Topi in the area where the quarry activity is carried out on Mount Gostencka.

During the confrontation, Topi stated that he did not have the documents with him to present at that moment, while claiming that the Jaupaj family did not have documentation for the property. When asked about the documents he said he possessed, the administrator stated that the police had taken them and that he did not have a copy with him.

The journalists contacted the police to request a patrol and information on the documentation. According to the report, the officers stated that the documents were at the police station, but the patrol that arrived at the scene did not have them with them. The police asked the parties to appear at the police station to file a complaint, while, according to the journalists, they did not conduct on-site verifications for the usage permits.

During the verbal clash, both sides disputed each other's claims. Miranda Jaupaj, determined to defend what she considers family property, declared: "I will defend my property with blood!" Meanwhile, Anesti Topi left the area, saying he would return to the quarry.

Property fencing and claims for mining permits

During their stay in the field, the journalists also contacted the head of the Skrapar Forest Service, Besnik Demko, to clarify whether the area could be fenced. According to the report, Demko stated that the fence could only be made in the part that belongs to the Jaupaj family. After the call, the installation of a wire mesh began, with the aim of preventing further passage and use of the part claimed by the heirs.

On the other hand, the administrator Anesti Topi claims that the company "Topi EKI" sh.pk exercises its activity in accordance with the law, having a mining permit and the relevant documentation from the Skrapar Municipality, the National Agency for Natural Resources, the National Business Center, the National Environment Agency and the Ministry of Infrastructure and Energy. According to the show, Topi has sent by email the documents he claims to have.

The heirs of the Jaupaj family, for their part, dispute these claims. They refer to ownership documents and administrative court decisions, claiming that the activity on their land is based on falsified documentation and that local government structures and state institutions are also involved in this process.
